Terms of Use
These terms are an agreement between you and K. M. Fisher Systems LLC, doing business as AYWA (“AYWA”, “we”, “us”), the publisher of the AYWA app. By using the app you agree to them.
1. What AYWA is
AYWA is a personal organizer and information app for tracking your cycle, pregnancy, recovery after birth and your baby’s care. It provides general information and estimates based on what you enter.
2. Not medical advice
AYWA is not a medical device and does not provide medical advice, diagnosis or treatment. Information in the app is general and may not apply to your situation. Always talk to a qualified health professional about your health, your pregnancy and your child, and don’t delay getting care because of something in the app.
In an emergency, call 911 or your local emergency number. AYWA can’t assess symptoms or tell you whether it’s safe to wait.
3. Estimates and contraception
Period, ovulation and fertile-window estimates are approximations from the dates you log, using the calendar method. Cycles vary, and estimates can be wrong. AYWA is not a contraceptive and must not be used to prevent pregnancy, or relied on as the only way to plan one.
4. Who can use AYWA
You must be at least 18, or the age of majority where you live, to use AYWA. You may record information about your own child as their parent or guardian.
5. Your information
What you log belongs to you. It is stored on your device and, if you create an account, backed up with your account, as described in our Privacy Policy. You are responsible for keeping your device and your email account secure. Without an account or a backup of your own, if your device is lost, reset or the app is deleted, your records may be lost, and we cannot recover them.
5a. Accounts and sharing
Accounts are optional. Give an email address you control, and keep it current so you can sign in. When you invite someone to a child’s care or to follow your pregnancy or cycle, you decide what they see and for how long, and you’re responsible for inviting only people you trust; what they already saw can’t be recalled. Invite someone to a child’s care only if you’re that child’s parent or guardian. We may suspend an account that’s used to break these terms, and you can delete yours at any time in the app.
6. AYWA Premium
- Some features require a paid subscription, AYWA Premium. The price, billing period and any free trial are shown before you buy.
- Payment is charged to your Apple ID when you confirm the purchase, or when a free trial ends.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in iPhone Settings → your name → Subscriptions.
- If you cancel, Premium continues until the end of the period you paid for. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com.
- If a free trial is offered, any unused part ends when you buy a subscription.
7. Acceptable use
Please don’t copy, modify, reverse-engineer or resell the app or its content, use it for anything unlawful, or try to disrupt it. We may update or discontinue features over time.
8. Our content
The app, its design, illustrations and written content belong to AYWA or its licensors. We grant you a personal, non-transferable licence to use the app on Apple devices you own or control, as permitted by the App Store’s Usage Rules.
9. Disclaimers
To the fullest extent the law allows, AYWA is provided “as is” and “as available”, without warranties of any kind, including accuracy, fitness for a particular purpose or uninterrupted availability. Some jurisdictions don’t allow certain disclaimers, so some of these may not apply to you.
10. Limitation of liability
To the fullest extent the law allows, AYWA will not be liable for indirect, incidental, special or consequential damages, or for lost data, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for AYWA in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
11. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app, including product liability, legal compliance or intellectual property claims. If the app fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You confirm you are not in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
12. Changes and ending
We may update these terms; we’ll change the date above and, for significant changes, tell you in the app. You can stop using AYWA at any time by deleting it (remember to cancel any subscription, and delete your account first if you have one).
13. Law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Orange County, Florida, except where the law of your place of residence gives you the right to bring a claim where you live.
